The good news in Spain is that GAZUMPING does not happen very often and here is the reason.


After you have agreed a sale price the lawyers for each party will arrange a purchase contract and within the contract there will be an agreed deposit amount that will be paid when the contract has been signed by both parties. The deposit is normally 3000 - 6000 euros and if the seller decides not to go ahead with the sale or if they receive a higher offer then the seller has to repay the deposit and also pay a penalty amount equal to the deposit.


This prevents gazumping and in the 14 years that we have been in business it has happened only once when a seller was offered a considerable amount more than the original sale price.
